DMCA Counter-Notification Policy 

In compliance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. S. 512(g), HB Hoops, LLC offers a counter-notification process for users who believe that content they posted was wrongly removed in response to a DMCA takedown notice. If you believe that your content was removed or access to it was disabled due to an error or misidentification, you may submit a formal DMCA Counter-Notification to request restoration of the content.

How to Submit a DMCA Counter-Notification:

To ensure your counter-notification is properly processed, please include the following information in a written communication to our designated DMCA Agent:

  • Identification of the material that was removed or disabled, including the specific URL or other unique identifier of the location where the material was accessible before removal or disabling.
  • A statement, made under penalty of perjury, affirming your good-faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  • Your full contact information, including your legal name, mailing address, telephone number, and email address.
  • A statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if you reside outside of the United States, for any judicial district in which HB Hoops, LLC is located. You must also agree to accept service of process from the person who submitted the original DMCA notification or their authorized agent.
  • Your physical or electronic signature.

Upon receiving a valid counter-notification, HB Hoops, LLC will promptly forward a copy to the original complainant. If the complainant does not file a lawsuit seeking a court order to keep the material removed within ten (10) business days of receiving the counter-notification, HB Hoops, LLC will take steps to restore the content or re-enable access to it.

This process enables us to fairly address claims of copyright infringement while protecting the rights of users who may be affected by misidentification or error.
