In alignment with our obligations under the Digital Millennium Copyright Act (DMCA) and applicable law, we have established the following policy for terminating user accounts in appropriate circumstances.
Policy on Account Termination for Repeat Infringers:
-
Criteria for Termination
HB Hoops, LLC reserves the right to terminate user accounts that are found to engage in repeated acts of copyright infringement. This determination is based on a series of DMCA complaints received from copyright holders, as well as any other evidence of infringement. Repeated and verified violations of intellectual property rights may result in account suspension or termination.
-
Notification and Review Process
If your account is subject to termination due to copyright infringement, you will receive a notification from HB Hoops, LLC with details regarding the infringements identified. Users may have the opportunity to respond to these notifications by providing a counter-notification if they believe the claims are in error, as permitted under the DMCA.
-
Appeal Process
Users who believe their accounts have been terminated in error may appeal the decision by contacting our designated DMCA Agent, providing relevant information and evidence supporting their appeal. HB Hoops, LLC will review appeals on a case-by-case basis and may, at its sole discretion, reinstate accounts where it finds sufficient grounds.
-
Finality of Termination
Account termination for repeated infringement is final. Users whose accounts have been terminated are prohibited from creating new accounts on HB Hoops, LLC without prior written consent. Unauthorized re-registration will result in immediate removal.
